A nurse sexually assaulted a vulnerable female patient during a night shift at the Royal Devon and Exeter Hospital.

Sunil Mushtaq was working as an agency nurse when he repeatedly rubbed himself against the patient’s hand and arm while she was being treated in A&E for vomiting blood and dehydration. On the final occasion, he used the woman’s hand to masturbate through his scrubs until he ejaculated.

The incident was captured on CCTV and Mushtaq was later identified through a DNA match. The victim went on to suffer a serious psychological breakdown as a result of the assault.

Mushtaq initially denied any wrongdoing but ultimately pleaded guilty to sexual assault. At Exeter Crown Court, he was sentenced to 18 months in prison. He was also ordered to complete 180 hours of unpaid work, attend 30 rehabilitation days, and sign the sex offender register for 10 years.

Sadly, this is not the first time we’ve seen headlines like this and it’s a stark reminder of how devastating it can be when a healthcare professional abuses their position of trust. The NHS and other healthcare providers have a legal duty to safeguard those in their care. That includes properly vetting agency staff, delivering clear safeguarding training, and taking swift action when concerns are raised. When failures occur then a victim of sexual assault in hospital may wish to explore the possibility of claiming compensation.
