Vulnerable Client with Special Measures Set Up for Trial Wins at Mediation

Hayley Bundey, a specialist trusts dispute Senior Consultancy Solicitor working in association with Slee Blackwell, has settled another TOLATA claim at mediation.

This was a sad case which should never have needed the steps Hayley ultimately had to take to issue and serve proceedings, with preparations being made for special measures being put in place for court hearings, and ultimately a trial where needed, because of the historic victimisation of our client.

Thankfully Hayley and her team managed to get the defendant to recognise the strong merits of the claim at mediation and finally made a sensible offer (despite over a year of attempts to get them to do so up to that point) so the claim settled without those special measures needing to be used; saving our client from further potentially traumatising experiences through the court process.

The client was vulnerable and bringing the claim took immense strength. The positive outcome at mediation has been life changing for them and very well deserved for holding their nerve and trusting Hayley to guide them through the process with her full support and encouragement along the way.

Hayley acted on a conditional fee agreement basis in this instance but she offers various forms of funding for these types of claims.

TOLATA claims often involve difficult, emotive factual backgrounds which can make it challenging for clients to find the strength to drag up that history in order to pursue the claim. Hayley welcomes instructions from vulnerable clients who need that extra helping hand to pursue the claim because she and her specialist consultancy team are always ready to support clients in doing all they can to make the process as manageable as possible for them to achieve the outcome they deserve.

Hayley’s Consultancy Team are specialist in managing these cases to a successful outcome, often at mediation. In the last year the team’s success rate at mediation has been 100%.
