Motorcycle accident victim receives £169,000 compensation after we advised him to reject initial offer of £80,000

Our client was the victim of a serious motorcycle accident when he was knocked off his bike by a car which suddenly turned into his path without indicating.
The accident resulted in him suffering multiple injuries, including fractured ribs, fractured collarbone and a collapsed lung. He also had to have his spleen removed in emergency surgery.
He decided to claim compensation for his motorcycle accident. He called our free legal helpline and lawyer Elizabeth Duncan agreed to work on a no win, no fee basis.
The driver of the car was prosecuted and found guilty. His insurance company accepted fault so it was then a question of calculating how much compensation the motorcyclist was entitled to receive.
We made arrangements to obtain expert reports from a range of medical specialists. Because his injuries prevented him from returning to work as a self-employed builder for a lengthy period we obtained interim payments of compensation while the claim was quantified.
A specialist accountant was appointed to calculate his lost earnings. These were higher than they would otherwise have been because Covid-19 made him vulnerability to infection arising from the loss of his spleen and this delayed his return to work.
The insurance company made our client an initial offer of just over £80,000. This was far too low in our opinion and the specialist barrister we consulted agreed with us.  The offer was therefore rejected and we continued with obtaining further evidence to support the claim.
Negotiations with the insurance company continued and an improved offer of £130,000 was made. However this was also turned down the basis that it did not adequate compensate our client for the extent of his injuries and the impact it had on his earnings.
Our approach was proved to be correct and an out of court settlement was eventually reached. This resulted in our client receiving compensation of £169,000 which was more than twice what the insurance company had originally offered him.
