The law governing accidents on an airplane is different to other types of accident. The most striking difference is the fact that the limitation period for an airline accident claim is only two years, rather than the normal three years.

Accidents occurring on a plane are governed by the Montreal Convention. The Convention even applies to some accidents that happen while the airplane is on the tarmac, including injuries that are sustained by passengers during the course of embarking or disembarking.

It is also important to appreciate that under the Montreal Convention an accident is regarded as a distinct event, which is not part of the usual, normal and expected operation of the aircraft. It therefore includes injuries caused to passengers by

  • luggage falling from overhead lockers;
  • aircraft trollies;
  • excessive turbulence;
  • trip, slips, and falls; and
  • allergic reactions.
