Making a military medical negligence claim.

Being in the military doesn’t exclude you from being able to make a medical negligence claim in circumstances where your military healthcare provider has failed to meet acceptable standards of medical care.

While there is no doubt that being in the military can be a dangerous profession, and injury can be sustained in the line of duty, this doesn’t mean that service personnel should be expected to accept a lower level of medical care. Whether you are treated in a combat situation or at an established medical facility, there are standards of care which must be met. Where those standards are not adhered to, and your health suffers as a result, then you may be entitled to bring a military medical negligence claim.

In order to make a successful medical negligence claim our lawyers will need to establish that the care you received from medical professionals in the services (including the Army, Navy, Air Force, Special Forces, and Reserve Forces) fell below the standard that could reasonably be expected, and that this resulted in your health suffering. You have three years from the date of the negligent treatment (or lack of treatment), or from the date that you became aware of the negligence, to make a compensation claim. Identifying the correct limitation date isn’t always straightforward. It is therefore important that you seek specialist legal advice as early as you can to avoid being ineligible to make a claim simply because the limitation period has run out.
