Dr Iuliu Stan, who worked at Treliske Hospital, Truro, Cornwall, in the department of Trauma and Orthopaedics for around five years, has been found guilty of misconduct by the Medical Practitioners Tribunal and struck off the Medical Register.
He subjected patients, some of whom were children, to unnecessary intimate procedures. On many occasions, he had failed to obtain informed consent and failed to offer alternative, more appropriate treatment. He also failed to follow the hospitalās chaperone policy and continued to ignore the policy after May 2020 when he was specifically asked to familiarise himself with it by a senior consultant.
It is now likely that victims of Dr Iuliu Stan’s conduct will pursue medical negligence claims.
To prove a claim for medical negligence you have to show that a doctor has breached their duty of care by acting in a way that no reasonably qualified doctor would have done. Failing to obtain informed consent would be considered such a breach of duty. Failing to offer a chaperone would also be considered a breach of duty, as would failing to consider and provide alternative or more appropriate treatment.
The tribunal report, which was published on in February 2024, details serious misconduct and breaches of trust and duty. The lengths Dr Stan went to for his own gratification has meant that potentially hundreds of patients are not only victims of medical negligence but also assault and abuse.
Dr Iuliu Stan was dismissed from the Trust in March 2021, but victims only began to be notified following the GMC tribunal outcome earlier this year.
