The three main ways of legal funding family law services:

  1. Private funding
  2. Litigation funding
  3. Legal Aid

Private funding

Private funding is the most common way of funding family law proceedings.

Typically, clients pay for the legal services they require by using their savings, income, credit cards or with help from family.

We require an upfront payment of £1,500 to start work on a family law case, unless it is a matter where we offer a fixed fee scheme – such as our fixed fee divorce option which starts at just £325 plus VAT and disbursements.

Family cases often require a lot of work to be carried out immediately. The upfront payment therefore allows this work to be undertaken swiftly and effectively.

Our client’s often have a varied approach on how they pay their invoices. Some clients wait until the initial payment has been fully used and will then make another payment to cover further works, while other clients choose to set up a standing order to keep topping up their account on a monthly basis.

Litigation Funding

Litigation funding is sometimes available to individuals involved in family law proceedings. This involves a loan being made to the client from a company specialising in litigation funding, with the lender being paid back, together with interest  at the end of the case.

Not all clients are eligible for this form of funding and it often requires the client to be entitled to recover a significant sum so the loan can be repaid. The lender will assess each case individually for eligibility.

Legal Aid

Legal Aid may be available to people in receipt of universal credit or on a low income. However, it is rare for Legal Aid to be granted for divorce, financial or child matters. Because of funding cutbacks many solicitors no longer offer Legal Aid, Slee Blackwell included. However, we can:

  • Assist you if you have received a Legal Aid rejection and do not know how to proceed;
  • Offer a Fixed Fee Divorce which helps minimise costs;
  • Provide a free initial consultation to assess the options open to you; and
  • Advise whether you would be likely to be granted Legal Aid if you were to make an application.
