Barnstaple accident at work victim wins compensation
David Vogler, a maintenance engineer with Atlas Packaging in Barnstaple, North Devon, suffered leg and hip injuries when the metal storage racking he was helping to assemble at work collapsed.
Staff shortages led to his manager trying to assemble the racking with assistance from just Mr Vogler and a young trainee who had been employed by the company for only 3 days, instead of the usual team of 4 experienced workers. No mechanical lifting equipment was provided by Atlas and the assembly was at ceiling height when it collapsed without warning. All three men were injured in the accident.
Mr Vogler, who was previously in the armed forces and a fit and enthusiastic runner, suffered acute soft tissue strains which have stirred up underlying arthritis and greatly reduced his ability to run. We were appointed by David Vogler to pursue a personal injury claim and dealt with the case on a no win – no fee basis.
The lawyer who dealt with the Barnstaple accident at work case said, “The lack of any proper planning or system for putting up this racking meant this was an accident waiting to happen. It is fortunate that David was not more seriously injured. Atlas Packaging’s insurers admitted liability for the accident and we obtained compensation of £3,500 for his injuries.”
