Accident in a car park case study 0 We have recovered compensation totalling £30,000 for a 90 year old woman who suffered an accident in a car park while attending a function at a golf club near Bristol.

The accident occurred as she was returning to her vehicle that was parked in the club’s car park. Unfortunately her foot got caught in an open drain on the pathway, causing a fracture to the neck of the femur of her left hip and multiple abrasions.

It was a nasty injury and meant she had to undergo complex hip surgery.  She is a fiercely independent lady and the consequent restrictions on her independence led to her developing depression; something not helped by the fact that a number of pre-planned holidays had to be cancelled.

She called our free legal helpline to find out whether she would be entitled to claim compensation for the accident in a car park. We told her that she was and agreed to take on her case, working on a No Win, No Fee basis.

We made a compensation claim against the golf club on the basis that the car park and surrounding pathways were defective and presented a danger to guests. The case we submitted was based on a breach of section 2 of the Occupiers Liability Act 1957.
An out of court settlement was reached with the insurers of the golf club. The agreed compensation package included private funding for much needed physiotherapy and psychological treatment in order to assist our client to make a full recovery from her injuries and continue to enjoy her retirement and future travels.
