Partner bought out of a property

Ex-Partner wins case to be bought out of a property after relationship breakdown.

Hayley Bundey, a specialist trusts dispute Senior Consultancy Solicitor working in association with Slee Blackwell, settled another TOLATA claim before court proceedings were issued, and within just three months of opening the file.

Our client and her ex-partner had bought a property together. However, following a breakdown in the relationship, our client wanted to be bought out of the property that she no longer resided in.

Our client’s ex-partner (who had instructed solicitors) made a low-ball offer to our client, who was unrepresented at the time. After instructing Hayley’s consultancy team, we were able to increase that offer by almost 100%.

It can be very emotive having to involve solicitors in the winding up of your relationship and dividing up your assets, especially when it involves dragging up events from many years ago. However, this case shows how beneficial it can be to get the closure both sides often want.

Hayley’s team acted on a privately funded basis in this instance, but she offers various forms of funding for these types of claims, including No Win No Fee.

The speed with which Hayley’s consultancy team resolved this case shows the importance of using specialist solicitors who are experienced in how to bring these cases to a swift and sensible conclusion, but also, when necessary, to prepare the case towards a successful outcome at trial.

Hayley’s Consultancy Team are specialist in managing these cases to a successful outcome, often via offers in correspondence or at mediation. In the last year the team’s success rate at mediation has been 100%.
