The lawyers in our specialist abuse department are pleased with the announcement of the Ministry of Justice on the proposed removal of time limits for claims being brought by survivors of childhood sexual abuse. This was one of the recommendations made in the final report of the Independent Inquiry into Child Sexual Abuse (IICSA). The proposal that the time limit (known as “limitation” in law) should not apply to child sexual abuse claims will be presented in a bill and will, hopefully, become law. This would remove a significant hurdle for those seeking justice for historic, non-recent sexual abuse.

Under current law, claims for abuse in childhood must generally be brought before the person turns 21 years of age, though it is possible for the courts to extend that time limit.

While this proposal is welcomed, as it will remove a hurdle for survivors seeking justice, Slee Blackwell partner and award-winning abuse lawyer, Elizabeth Duncan, advises a cautious approach. She says:

“While this is undoubtedly a welcome announcement and a significant step forward for survivors of abuse, I remain concerned about what practical difference it will make. For example, it appears from reports that even if the time limit is abolished, legal liability could still be avoided if defendants can prove that it is not possible for there to be a fair trial due to lack of evidence – an issue which becomes more challenging with the passage of time. We will therefore continue to encourage survivors not to delay in seeking legal advice.”
