‘Lessons learned from my successful trial’: The personal experiences of a man who was denied his promised share of a house and went on to win his claim at court

This article follows on from our previous one (that you can read here) about an emphatic victory Hayley Bundey, a solicitor in our specialist inheritance disputes team, recently won at trial. The case involved a man who had been denied his promised share of a house. In this post our client gives his own perspective on the case and the lessons he has learned, which he hopes will help others in similar situations.

“My claim against my ex-partner was to uphold an agreement that she broke regarding my promised share of a house.

I had no idea that our agreement would be denied by my ex, but winning this case means that I can get on with my life, feeling that justice has been served and that right has won the day. The dishonesty of the defending side has been clearly demonstrated in court for all to see and this is a huge aid in healing the hurt of being wronged by people that I had loved who turned against me due to money.

Financially the award by the court will help me move forward with my life in the manner that I originally expected.

The legal process has been a long one. Slee Blackwell took the case on and steered it towards settling out of court. Right up until the last moment they were putting proposals to the other side so that a contested trial could be avoided. They kept control of a very complicated process in which they’ve had to anticipate possible problems and they’ve done this expertly. They gave every opportunity for my ex-partner to mediate (which she refused) and have had to deal with difficult people. They’ve been tenacious, honest and organised. Hayley has looked after my interests very well and shown great initiative. She has great forward thinking, with both a strong overview and a strong command of detail. I cannot praise Hayley enough for her abilities and care towards me and my case. Our barrister also expertly steered his questioning to reveal the truth in court. It made me very emotional to see the truth exposed so clearly. It was profound and healing.

Starting legal action is clearly a serious business. In some instances it’s the only way to put right a wrong that has been done. If my solicitors had not been so ‘on the ball’ by picking up on the defendant’s inconsistencies we could have lost. Slee Blackwell gave me good legal advice and now justice, and all that it means, has been done as a result of their involvement.

The win in my case means that I can return, albeit many years later than desired, to my original plan to supplement my endeavours as a musician and songwriter, which has been my calling for most of my life. I spent one year with no income of any kind at all, and no savings, as a result of my ex breaking our agreements. I therefore suffered greatly and the effect on my morale was devastating. I can now expect more security, happiness and control over my life due to previously expected funds being restored. Justice is a good thing if you can get there and you sometimes can’t achieve it without taking legal action. That’s why you need intelligent and organised experts on your side. I’m grateful to Slee Blackwell for their efforts which have aided me greatly in releasing myself from being a victim. It’s a sad tale but I hope my ex will learn something and find happiness in the future.”
