Slee Blackwell negotiate multi-million pound clinical negligence settlement
The head of our clinical negligence team, Oliver Thorne, has reached a multi-million pound compensation settlement for an elite sportsman who is now on course to reach the Paralympic Games.
His client had to undergo a below-knee amputation following a Devon hospital’s a failure to diagnose and treat septic arthritis.
Oliver dealt with the clinical negligence claim on a No Win, No Fee basis. He presented the case on the basis that Devon Healthcare Trust failed to appreciate the severity of the injury when his client went to the Accident and Emergency department.
Devon Healthcare Trust argued that even if they had immediately diagnosed and treated the condition it  would not have avoided the need for the amputation.
The long running case, which has lasted nearly 5 years, reached a final conclusion following a full day of negotiations between the legal teams.
The out of court financial settlement will ensure Oliver’s client has access to prosthetic limbs and future support. This includes aids and equipment to enable him to reach his new goals as a Paralympic athlete.
Oliver commented:
“My client’s positive attitude towards life and overcoming his injury has been nothing short of inspirational and I look forward to hearing about his success as a Paralympian in the future. His optimistic outlook drove the team to ensure he was fully and properly compensated. From a legal point of view this was an incredibly complex case, but I am extremely pleased that we achieved the right result
