We are specialist farm dispute solicitors, operating nationwide.
Our specialist teams offer a range of farm dispute services:
Proprietary estoppel
In the area of property and inheritance, we are highly experienced in dealing with cases involving the legal doctrine of proprietary estoppel. Although many people are not familiar with the term ‘estoppel’ it is very common in farming disputes.
You can read all about proprietary estoppel in our article on family farm inheritance disputes, but in summary, a proprietary estoppel claim arises when someone makes you a promise, you act on that promise to your detriment, but the maker of the promise then tries to renege on it.
To make an estoppel claim, the following three requirements must have been met:
(i) a promise or representation has been made,
(ii) the recipient has relied upon the representation or promise, to their detriment, and
(iii) it would be unfair and unconscionable not to uphold or enforce the promise.
We represent clients who are bringing estoppel claims, and those who are defending them. We offer a free case assessment service and a range of funding options, including no win – no fee.
Partnership disputes
Our civil disputes team is experienced in handling farming partnership disputes and company disputes, offering a practical and cost effective service on a national basis. We are always happy to review a case free of charge and discuss how we will be able to help resolve the dispute.
