The amount of compensation you can claim in a food allergy case will vary according to the severity of the reaction and its impact on you as an individual. According to the ‘Judicial College Guidelines’ in 2024, the compensation for ‘Pain and Suffering’ in cases involving moderate and severe allergic reactions can range between £3,710 and £18,020.

  • Moderate Reactions: Compensation can range between £3,710 and £8,200 for a moderate reaction that results in significant discomfort from which the victim fully recovers within a few weeks or months.
  • Severe Reactions: In cases involving more severe symptoms, such as those requiring hospitalisation or leading to long-term health consequences, compensation can range from £8,200 to £18,020.

It is important to appreciate that these figures apply exclusively to the ‘Pain and Suffering’ element of a claim for a food allergy. In addition to this figure, the victim can also recover compensation for their financial losses. These are set out above in more detail and include past and future loss of earnings, medical expenses, and travel costs, all of which can significantly increase the overall award of compensation.
