Breach of contract success

This is a case study of a successful breach of contract claim that our civil disputes team has recently handled.

Our client, a water and sewerage pump company, provided quotations to a customer for borehole and filtration systems. The quote was accepted and a contract entered into. Our client made it clear that all equipment and services would be aligned with the specifications outlined in the agreement and the independent water analysis provided at the project’s outset.

There were initial installation issues, but these were promptly rectified at our client’s own expense. However, our client’s invoice for the substantial works undertaken by them remained unpaid. Zoe Harker-Smith in Slee Blackwell’s civil dispute team was therefore instructed to pursue a claim for the monies owed.

The customer refused to pay on the basis of concerns over water quality. However, we established that these concerns surfaced months after the project was completed. Following additional water tests and site visits, these issues were not found to be the result of the equipment supplied by our client or their installation. We were therefore able to successfully challenge the allegation that equipment flaws were responsible for these issues.

To avoid costly litigation, on behalf our client we proposed a resolution under consumer law, suggesting that the disputed filtration equipment be removed from the plant room at no additional cost the customer.

We specified that the offer would be open for acceptance for a set period of time and that failure to accept the offer would result in Slee Blackwell issuing legal proceedings on our client’s behalf for breach of contract to recover the outstanding debt and associated legal costs.

Following negotiations, the customer agreed to pay our client for their services and the dispute was successfully resolved in our client’s favour.
