If you are subject to A SHPO, then you will know how significantly it can affect everyday life. Restrictions on internet use, contact with certain individuals, travel, employment, and other activities can continue for many years, even after any criminal sentence has been completed.
Our specialist SHPO solicitors can advise on whether a Sexual Harm Prevention Order can be varied, reduced, or discharged entirely.
What is a Sexual Harm Prevention Order?
A Sexual Harm Prevention Order, commonly known as a SHPO, is an order made under the Sexual Offences Act 2003. It is designed to protect the public from sexual harm by imposing restrictions on an individual.
A SHPO can contain a wide range of conditions, including restrictions relating to:
- Internet and social media use;
- Contact with children or vulnerable people;
- Foreign travel;
- Employment activities;
- Possession of certain devices;
- Notification requirements.
Breaching a SHPO is a criminal offence and can result in further prosecution.
Can a Sexual Harm Prevention Order be removed?
Yes.
Many people assume that once a SHPO has been imposed, there is nothing they can do about it. However, the law allows a SHPO to be varied, renewed or discharged by the court in appropriate circumstances.
Most applications are made by the person subject to the order, although the police can also apply.
When can you apply to discharge a SHPO?
In most cases where a SHPO was imposed following conviction, you must wait five years before applying for discharge unless exceptional circumstances exist and the relevant police force consents.
Where an order was imposed without a criminal conviction, applications can generally be made sooner, although the court will normally expect to see a material change in circumstances.
What does the court consider?
The court’s primary concern is whether the order remains necessary and proportionate for public protection. Good behaviour alone is not enough. The court will consider a range of factors, including:
- Compliance with the order;
- Whether any further offending has occurred;
- Evidence of rehabilitation;
- Changes in personal circumstances;
- Stable employment;
- Family and support networks;
- Risk assessment evidence;
- Whether the restrictions remain necessary.
A well-prepared application, supported by appropriate evidence, can significantly improve the prospects of success.
How our SHPO solicitors can help
Our experienced criminal defence solicitors can assist with every stage of the process, including:
- Reviewing the original SHPO;
- Advising on eligibility to apply;
- Gathering supporting evidence;
- Preparing the application;
- Liaising with the police;
- Representing you at court hearings.
We will assess the strengths and weaknesses of your case and advise on the best strategy for seeking a variation or discharge.
SHPOs and Sex Offender Registration
Many people are unaware that an indefinite SHPO can have implications beyond the restrictions contained within the order itself.
Where an indefinite SHPO remains in force, associated notification requirements can continue long after the original statutory registration period would otherwise have expired. In appropriate cases, successfully discharging the order can therefore have wider benefits.
