Compensation of £170,000 awarded in a dog attack claim involving a child
The background to the claim
Our client, a young girl, was visiting a nature reserve with her mother when they were approached by a dog owner with an unleashed dog. The owner assured them her dog was safe and encouraged our client to give it treats. However, without any warning or provocation the dog suddenly attacked. It bit our client on the head and shoulder, dragging her to the ground, and her mother had to physically intervene to pull the dog away.
Emergency assistance was required, with bystanders calling an ambulance when the dog’s owner became too distressed to use her phone. Police and paramedics attended, and our client was taken to hospital with significant injuries.
Our client’s injuries
The consequences for our client were significant. She had to undergo multiple operations and extensive medical treatment. She has been left with a large scar on her scalp that has resulted in permanent loss of hair growth. As a result, she will require hairpieces for the rest of her life. She also suffered psychological effects necessitating a referral to child mental health services.
Legal proceedings against the owner of the dog
Criminal proceedings were brought against the dog owner, who entered a guilty plea. However, despite this, the owner denied liability when we advanced the civil claim for compensation, putting forward an alternative account of the incident.
Settlement negotiations
Even though the claim was defended, the owner’s insurers put forward an offer of £40,000. This was rejected on our advice.
After gathering full medical evidence and setting out the long-term impact of the injuries, we were able to reach an out of court settlement of £170,000.
We also secured a further £25,000 for the child’s mother. She was recognised as a ‘secondary victim‘ after developing post-traumatic stress disorder and a depressive disorder as a result of witnessing the attack.
