We have recently recovered substantial compensation for a driver injured in a truck accident.
Our client was driving a dumper truck off a low loader when the accelerator jammed. This caused the dumper truck to shoot forward. In fear of catastrophic injury, the driver threw himself off the dumper truck, sustaining a serious injury to his shoulder in the process.
The driver who was injured in the truck accident asked us to deal with his compensation claim and we agreed to work on a No Win, No Fee basis.
We formally notified the claim to his employers, explaining why we believed they were to blame. Happily their insurers admitted legal responsibility for the truck accident quickly. All that then remained to be done was to calculate the value of the claim and whether anything could be done to help the driver recover from his injuries.
First, we obtained an interim compensation payment from the insurance company to help him manage financially while the claim was being dealt with.
We then arranged for him to be examined by an independent Consultant Orthopaedic Surgeon. The surgeon concluded that despite surgery and physiotherapy, he had been left with a very badly damaged shoulder with associated muscle wastage. The driver would never be able to do heavy work again and as he was now in his 50s and had worked in building, carpet laying and truck driving his whole life this was naturally a huge concern for him.
The Orthopaedic Surgeon believed that a full shoulder replacement might help him to regain better use of his shoulder and arrangements were made for this to be carried out.
We requested a further interim compensation payment to support him through the period of recuperation from surgery as he would obviously be unable to work and very dependent on his wife for personal care. Unfortunately the insurance company would not make a further payment. We therefore commenced court proceedings and applied to the court for an order forcing them to pay.
As a consequence of taking this approach the insurers made an offer to settle the whole claim out of court. However the level of compensation they offered was nowhere near enough, especially given the huge impact the injury had on our client’s life and ability to work. We therefore pressed on with the court action.
When the independent medical expert carried out a re-examination, he found that although there had been some improvement, our client still had major restrictions Unfortunately, the expert believed that these problems were likely to be permanent.
Following a period of negotiation with the insurance company we were subsequently able to finalise a substantial compensation settlement package for our client. This not only made up for the lost earnings he had suffered since his truck accident, but enabled him to begin a new business venture to secure his financial future.
