Financial disputes in divorce

The change in divorce law in April 2022 to allow couples to start divorce proceedings under the ‘no fault’ rule (see our link here) has simplified the procedure immeasurably. In fact the online process is now so straightforward that we recommend that our clients complete the divorce application form themselves, rather than paying for us to do it for them.

However, the online divorce application is only the start of what can be a long, complicated, and stressful process. This is because money is nearly always involved, which invariably leads to disputes. And this is where it can pay to have an experienced divorce lawyer fighting your corner.

Having clear, specialist guidance to navigate you through the financial settlement stage of your divorce can also help to minimise the stress and bring matters to a faster conclusion.

In addition, direct, focussed, expert advice can be highly cost-effective.Some people may think that ‘going it alone’ will save time and money. However, this can be a false economy, and we would always recommend that you seek advice and support from a specialist solicitor from the outset.

Our family law team are experienced in dealing with all stages of the process. From the word go, we can assist in the background, letter writing, attending court hearings, or advise on specific questions or documents, such as statements and financial disclosure forms (Forms E and D81 if you want the technical legal jargon).

While we can help you out at any stage, it is usually best to involve us from the start.  This is because if we are brought in at a late stage we will have to look at everything you have done yourself before retaining us.  Important information may be missing, or evidence may need reworking, or be completely wrong.

Because we are an arm’s length away from the emotion, turmoil, and frustrations you are feeling, we can analyse the legal issues with a degree of perspective.  It is well known that divorce (along with moving house and losing a loved one) is one of the top three most stressful situations we ever experience, so it’s important to have someone by your side that can minimise the impact on you and share the strain. Our clients tell us that having a specialist they can trust, who can do the thinking and worrying for them is hugely beneficial.  We may not always tell you what you want to hear, but we will be direct, honest, and frank with you, and get you through to the other side.

Everyone’s situation is different and we at Slee Blackwell understand that.  Our services can therefore be tailored to suit you and your needs. To find out more about how we can help with financial disputes in divorce just give us a call on 0333 888 0404 or email us at [email protected]
