The Paris Court of Appeal ruling on 20th May 2021 confirmed́ that the German company which certified substandard PIP breast implants, TUV Rheinland, are legally liable for the injuries they have caused.
TUV allowed the French manufacturers to use the CE mark up to 2010 even though the implants were filled with highly dangerous industrial grade silicone.
A very high proportion of those implants have ruptured and even where rupture has not occurred women have nevertheless suffered stress and anxiety with the thought that silicone could be spreading throughout their body. If the implant ruptures, the silicone can form lumps which cause pain and become inflamed. It can block the lymph nodes and in particularly serious cases it can travel to vital organs in the body, including the lungs.
There had previously been doubts about TUV’s legal liability, especially after a setback in the Aix-en-Provence Court of Appeal some years ago which left victims worldwide worried that they might not be able to recover compensation. However, the ruling now gives British women the opportunity of claiming compensation for the injuries and distress they have suffered as a result of receiving PIP implants.
Compensation will be evaluated individually, on a case by case basis. It is anticipated at this stage that affected women can expect to receive between 20,000 to 70,000 euros. A first judgment on the amount of compensation to be paid is expected later this summer.
The impact of defective PIP implants on the heath of children who have been breastfed with TUV-certified silicone is also under consideration.
Any woman who has not already received compensation is invited to come forward and join the next group of cases being presented to the court in what is known as the TUV 5 procedure.
