Can I claim compensation if I am injured by faulty goods? We look at the law regarding product liability claims.

If you are injured by faulty goods you have bought in the UK then you may be able to claim compensation from the company that sold them to you or from the manufacturers. Goods that are on sale to the public in this country are required by law to be safe for people to use. Consumers enjoy extensive legal protection and are entitled to claim compensation if a product that has been properly used causes them personal injury.

What type of goods can cause injury?

The list of goods that cause injury to consumers is endless, Some of the more common ones that we have dealt with are:

  • electronic goods;
  • sports equipment;
  • beauty products & cosmetics;
  • packaging;
  • medicines;
  • food;
  • medical equipment;
  • home and garden products; and
  • toys and games.

What should I do if I am injured by faulty goods?

 If you are injured by faulty goods you should speak to a solicitor who specialises in product liability claims as soon as possible. We operate a legal helpline. It is entirely free, so you have nothing to lose by giving us a call.
We will explain what is involved in making a claim and how No Win, No Fee works.
To help your claim succeed it is important that you:

  • Keep the faulty goods. The item will need to be inspected by the retailer or manufacturer so it should be safely retained in the same condition it was in when the injury occurred. Do not be tempted to try to fix or repair any defect;
  • Keep receipts and any other paperwork such as delivery slips, instructions and guarantees; and
  • Take photographs of the goods if they are likely to deteriorate.

It is sometimes necessary to arrange for an ‘expert’ to inspect the faulty goods and prepare a technical report in support of the claim explaining what the defect was and how the accident occurred. If this is necessary then we will fund the cost of that expert’s report.

What compensation am I entitled to if I have been injured by faulty goods?

If you have been injured by faulty goods you will be able to claim compensation for your injuries. The amount you receive will depend on how serious the injury is and how long it takes you to recover. If you are left with any permanent scarring or other permanent symptoms then this will be taken into account. In addition to compensation for your injuries we will also be able to recover any earnings you have ;lost as a result of the accident along with your out of pocket expenses such as medical costs and travel.
