Divorce

Divorce can seem very daunting but the legal process itself is actually very straightforward. To issue court proceedings for divorce you need to have been married for a year and have a legally valid reason for wanting a divorce.

The legal test for getting a divorce is that the marriage has "irretrievably broken down". This can be established by reference to one of 5 "facts" (grounds). They are

  1. adultery
  2. unreasonable behaviour
  3. two years separation
  4. two years desertion or
  5. five years separation without consent.

We can give you advice about which of these grounds is most likely to be your best option and explain the procedure to be followed all the way through to the divorce being made final, known as the "Decree Absolute".
